Thank you for purchasing the Mickey B DVD.

Please note the following essential information on licensing terms:

Individual Rate DVDs are licensed for individuals (home and private use) only.

Institutional Rate DVDs are licensed for hospitals, outpatient clinics, universities, colleges, libraries, companies, societies and other organisations. These rates include a licence which grants permission to loan the DVDs to the customers (including inter-library loan) and/or screen the DVD before a public audience within the organisation that bought that particular DVD only (it does not include radio, TV, internet and other means of broadcasting of the whole or part of the DVD outside of the physical address of the organisation concerned). Purchase of our DVDs constitutes an agreement to these licensing terms.

Return Policies
If you're not fully satisfied with a DVD purchase, return it for a full refund, excluding shipping and handling, within 30 days of our postage date. Items must be returned in original condition in original packaging with shipping prepaid. We will not give any refund for merchandise damaged due to poor packaging on returns. Please enclose a copy of your invoice / receipt / packing slip to ensure proper credit. Please allow 7 to 10 working days processing time for credit adjustments on modified orders or returns.

To guarantee delivery, please send your package by registered post or ship it by UPS or Fedex. Returns must be sent post-paid to:

Licence Terms ("terms")

  1. Licence
    In consideration of the Licence fee paid by the Customer* to the Educational Shakespeare Company Ltd, the Educational Shakespeare Company grants the Customer a non-exclusive non-transferable licence (with no rights of sub-licence) to use the DVD on the terms and as set out here which, subject to any non-excludable laws, are the entire terms governing the Customer's use of the supplied DVD.
    * this fee is included in the price of the DVD.
  2. Two types of licences
    a) Individual licence: DVD with this licence are licensed for individuals (home and private use) only.
    b) Institutional/community licence: DVD with this licence are licensed for hospitals, outpatient clinics, universities, colleges, libraries, companies, societies and other organizations. This licence grants permission to loan the DVDs to the customers (including inter-library loan) and/or screen the DVD before an audience in the organisation that bought that particular DVD only (it does not include radio, TV, internet and other means of broadcasting of the whole or part of the DVD outside of the physical address of the organisation concerned).
  3. Right of Use
    a) The supplied DVD is copyright and is strictly for the Customer's own use and must not be copied for distribution, publication or dissemination in whole or in part without the Educational Shakespeare Company's prior written permission.
    b) Unauthorised copying or modification of the supplied DVD is expressly forbidden and is a breach of the Educational Shakespeare Company's copyright.
    c) Purchase of our DVD constitutes an agreement to these licensing terms. Please inquire about other licenses and public performance rights. We will try to accommodate your specific needs.
  4. Property and Ownership of the Data
    The Licence granted to the Customer in these terms does not cause any transfer or assignment of any rights in the data to the Customer. Ownership of the rights in it remains with the Educational Shakespeare Company and nothing in these terms shall assign or transfer to the Customer any rights in the copyright or other intellectual or industrial property rights in the DVD supplied to the Customer.
  5. Termination
    Educational Shakespeare Company may terminate this Licence granted to the Customer immediately:
    a) if the Customer is in breach of any clause of these terms; or
    b) if the Customer fails to make payment to the Educational Shakespeare Company for this Licence.
    Immediately upon termination of the Customer's Licence for any reason whatsoever, the Customer's rights under these terms shall cease except as provided in paragraph 7 below. The Customer shall then immediately, and at its cost, return the original DVD together with any copies to the Educational Shakespeare Company Ltd.
  6. Waiver and Exercise of Rights
    The failure of either party to insist upon a strict performance of any of the terms of this Licence shall not be deemed a waiver of any subsequent breach or default in the terms of this Licence. The acceptance by the Educational Shakespeare Company or its agent of any money paid under these Terms after any breach or default by the Customer of any one or more of the terms of this Licence, whether before or after the Educational Shakespeare Company has knowledge or gives the Customer notice of any breach or default, shall not constitute a waiver by the Educational Shakespeare Company of that breach or default. The expiration or termination of this Licence shall be without prejudice to the rights of either party against the other in respect of anything done or omitted to be done under this Licence prior to such expiration or termination or in respect of any sums of other claims outstanding at the time of expiration or termination.
  7. Validity of Each Term
    If any term of this Licence is not valid or cannot be enforced for any reason all other terms remain valid and enforceable.

PRICING/LICENCES

Please note the price of the DVD is for Educational Multi-Site use (detailed below) and is applicable to orders from U.K./R.O.I. educational establishments only. Prices are exclusive of P&P and, whilst we will endeavour to maintain these as stated for as long as possible, are subject to change without further notice.

The price of a product from Educational Shakespeare Company Ltd (ESC) includes limited Public Performance Rights and entitles the purchaser to certain benefits of usage of the programme material contained on the tape or disk. The purchase price therefore covers not only the cost of the physical 'carrier' (tape or disk), but also a 'licence' to use the programme by a particular customer type (either 'Educational', 'Professional' or 'Business' - our definitions apply) at one or a number of sites. Therefore, in order to price fairly and accurately for all customers, ESC scenarios, and will apply the licence/pricing relevant to each particular customer type and intended usage at the time of ordering.

As a brief guide, types of Public Performance Licence available to U.K./R.O.I. direct retail customers include:-

  • SINGLE-SITE LICENCE (either 'Educational' or 'Professional' depending upon establishment type)
    Applies to purchases where the tape or disk is to be used within a single site by the purchaser only, and not loaned, hired or shown to any other party outside of that single site except in the private house of any individual in the employ of the purchaser and based at the site.
  • MULTI-SITE LICENCE (either 'Educational' or 'Professional' depending upon establishment type)
    Applies to purchases where the tape or disk is to be used at multiple sites operated by the purchaser and/or loaned or hired to other users. This licence also allows viewing in the private house of any individual in the employ of, or otherwise authorised by, the purchaser.

There is also a special licence available for business training purposes, and a 'general educational' (EGS) licence applicable to products supplied to U.K.-based trade customers and direct to overseas purchasers.

It is a violation of copyright law to copy, duplicate, edit, or broadcast its content for any reason, or by any means, without prior written permission from the copyright holder or authorised distributor. If you should wish to perform any of these actions, please contact us immediately so that we can arrange the necessary clearance. Neither the copyright holder, or authorised distributor, makes any warranties, representations or undertakings about programme content (including, without limitation, the quality, accuracy, completeness or fitness for any particular purpose of such content).

PLEASE NOTE that the DVDs we sell are of either the PAL/SECAM or NTSC standard. This means that your equipment (DVD player and TV) will need to be compatible with this. However, most DVD players sold in PAL countries (e.g. UK, New Zealand, Australia, most of Europe) play both standards.
